1. Agency Relationship

TLC Getaways acts solely as an agent for airlines, cruise lines, wholesalers, hotels, tour operators and other travel suppliers. Your travel arrangements are subject to the separate terms and conditions of each supplier.


2. Supplier Terms Govern Your Booking

All bookings are subject to the supplier’s rules relating to fares, pricing, availability, changes, cancellations, refunds, credit notes, baggage, and service delivery. Your entitlements are determined primarily by these supplier terms.


3. Prices Are Subject to Change

Prices may change at any time prior to full payment and confirmation. Increases may occur due to currency fluctuations, government charges, fuel surcharges or supplier-controlled adjustments.


4. Non-Refundable Components

Many travel products—including flights, cruises, promotional fares and accommodation deals—contain non-refundable or non-changeable elements. It is your responsibility to understand these conditions prior to booking.


5. Service Fees Apply

TLC Getaways may charge service, administration and cancellation fees, which are generally non-refundable, except where required by law. Supplier fees are separate and may also apply.


6. Refunds Are Not Guaranteed

Refunds, credits and amendments are strictly governed by the supplier’s policies. Processing times vary and may take several weeks or months. TLC Getaways cannot issue refunds until they are received from the supplier.


7. Accuracy of Traveller Information

You must provide correct traveller details, including full legal names matching passports. Errors may result in additional costs or refusal of travel.


8. Passport, Visa & Health Requirements

You are fully responsible for obtaining valid passports, visas, vaccinations and meeting all international entry and health requirements.


9. Travel Insurance Strongly Recommended

Comprehensive travel insurance is strongly recommended to protect against cancellation, medical expenses, lost luggage, travel disruption and other risks.


10. Australian Consumer Law

Nothing in these Terms & Conditions limits, restricts or modifies any rights or remedies you may have under the Australian Consumer Law (ACL).


 

                                     TLC GETAWAYS – FULL TERMS & CONDITIONS

Please read these Terms & Conditions carefully before making any booking with TLC Getaways. By requesting a quote, confirming a booking, or paying a deposit, you acknowledge that you have read, understood and agree to be bound by these Terms & Conditions, together with any terms and conditions of the relevant travel suppliers.

Nothing in these Terms & Conditions is intended to exclude or limit any rights you have under the Australian Consumer Law (ACL).


1. Our Role – We Act as an Agent

1.1 Agent for Travel Suppliers
TLC Getaways acts as a travel agent. We arrange and sell travel products on behalf of third-party suppliers such as airlines, cruise lines, tour operators, wholesalers, hotels, car hire providers, insurance companies and other travel service providers (“Travel Suppliers”).

1.2 Separate Contracts
When you book through us, you enter into:

  • A contract with TLC Getaways for our booking & advisory services; and 
  • One or more separate contracts directly with the Travel Suppliers for the actual travel products such as flights, cruises, accommodation, tours, etc. 

1.3 Supplier Terms Apply
Each Travel Supplier has its own terms and conditions, including rules on payment, changes, cancellations, refunds, credits, baggage, conduct and liability. These are in addition to our Terms & Conditions and form the basis of your contract with that Supplier. Your rights to amend, cancel, obtain a refund, or claim compensation will largely depend on those Supplier terms.

We strongly recommend that you review all relevant Travel Supplier terms and conditions before finalising your booking.


2. Definitions

In these Terms & Conditions:

  • “We”, “us”, “our” means TLC Getaways (ABN 65 848 878 675), based in Blackbutt, Queensland. 
  • “You”, “your” means the person making a booking or enquiry, and all travellers on that booking. 
  • “Booking & Advisory Services” means our services in advising, quoting, planning, managing and arranging travel products with Travel Suppliers. 
  • “Travel Supplier” means an airline, cruise line, tour operator, wholesaler, hotel, car hire provider, insurance company or any third party providing travel products. 
  • “Travel Product” means any travel-related product or service supplied by a Travel Supplier, including but not limited to flights, cruises, accommodation, car hire, tours, packages and insurance.
     

3. Key Points – Executive Summary

While you should read this entire document, some key points are:

  • Prices and availability can change at any time until paid and confirmed, and sometimes even later due to Supplier-controlled surcharges, taxes or currency changes. 
  • Some bookings are non-refundable and non-changeable. It is your responsibility to understand this before committing. 
  • TLC Getaways may charge service fees which are generally non-refundable. We may also receive commissions or incentives from Travel Suppliers. 
  • Your rights to a refund, credit or change are primarily governed by the Travel Supplier’s terms and conditions. 
  • You are responsible for checking passport, visa, health, vaccination and travel advisory requirements, and ensuring your details are correct. 
  • Your contractual rights in relation to the performance of the Travel Product (e.g. flights, cruise, hotel) are against the Travel Supplier, not TLC Getaways, except where required by the ACL.
     

4. Prices, Taxes & Availability

4.1 Indicative Pricing
All prices are in Australian dollars (AUD) unless stated otherwise and are usually based on twin-share accommodation (where relevant). Prices are subject to change at any time prior to full payment and confirmation.

4.2 Changes After Booking
Prices may change after your booking due to factors such as:

  • Currency fluctuations 
  • Fuel surcharges 
  • Government taxes or airport charges 
  • Seasonal or demand-based pricing set by Suppliers 

If a Travel Supplier adjusts their prices after your booking, we will advise you as soon as we become aware and explain your options. Your options depend on the Supplier’s terms and any rights under the ACL.

4.3 Taxes
Prices normally include taxes that must be prepaid (e.g. airline taxes). However, some taxes or charges are payable locally on arrival or departure, such as local city taxes or airport fees. These are your responsibility.

4.4 Availability & Withdrawals
All Travel Products are subject to availability and can be changed, limited or withdrawn by the Travel Supplier without notice. We are not responsible for any such changes or withdrawals made by the Supplier.


5. Fees, Service Charges & Commissions

5.1 Service Fees
We may charge professional service fees for:

  • Booking and managing flights, cruises, accommodation, tours and packages 
  • Processing changes, cancellations and re-issues 
  • Handling insurance enquiries or claims 
  • Providing additional advisory or documentation services 

Any applicable fees will be disclosed to you before you confirm your booking.

5.2 Supplier Fees
Travel Suppliers may charge their own booking, amendment, cancellation and “no show” fees. These are in addition to any TLC Getaways fees.

5.3 Commissions & Incentives
We may receive commissions, incentives, gifts or other financial benefits from Travel Suppliers in relation to your booking. These amounts are separate from any service fees you pay us.

5.4 Non-Refundable Fees
Our service fees and some Supplier components are generally non-refundable, even in the event of a cancellation or force majeure event, except where a refund is required by law.


6. Deposits, Payments & Payment Methods 

6.1 Deposits
A deposit (or multiple deposits) may be required to secure your booking. The amount and due date depend on the Travel Product and Travel Supplier.

  • Deposits are generally non-refundable if you cancel for change-of-mind. 
  • In some cases, full payment is required at the time of booking (e.g. certain promotional fares or last-minute deals). 

6.2 Final Payment
Final payment must be made by the due date advised. If full payment is not received by the due date, the Travel Supplier may cancel your booking and apply its own cancellation fees and loss of deposit.

6.3 Payment Methods & Surcharges
We will advise accepted payment methods (e.g. bank transfer, card) and any card surcharges or fees at the time of booking. Surcharges are typically non-refundable.

6.4 Processing Times
Direct deposits or bank transfers may take several business days to clear. You must allow sufficient time so that funds reach us before the payment due date.


7. Booking Details, Accuracy & Authority

7.1 Correct Details
You are responsible for ensuring all names, dates of birth, travel dates and details provided to us match your passports and identification documents exactly. Errors may result in:

  • Additional fees 
  • New tickets needing to be purchased 
  • Denied boarding or refusal of service by the Supplier 

We are not responsible for losses or costs arising from incorrect or incomplete information you provide.

7.2 Booking on Behalf of Others
If you make a booking on behalf of other travellers, you:

  • Confirm that you have authority to act on their behalf; 
  • Agree to share these Terms & Conditions and the Supplier terms with them; and 
  • Accept responsibility for their compliance.
     

8. Changes, Cancellations & Refunds

8.1 Cancellations by You
If you cancel a booking, your entitlement to any refund, credit or waiver of fees will be determined by:

  • The Travel Supplier’s cancellation policy; and
  • Any applicable rights under the ACL. 

Many fares, cruise deals and special offers are non-refundable or involve significant cancellation penalties.

8.2 Our Cancellation & Amendment Fees
In addition to Supplier charges, TLC Getaways may charge cancellation and/or amendment fees to cover the time and administration involved in handling changes, cancelling arrangements and processing refunds or credits.

These fees:

  • Are generally non-refundable, except where required by law; and 
  • Are separate from any Supplier fees or forfeited amounts. 

8.3 Cancellations or Changes by Suppliers
If a Travel Supplier cancels, alters or suspends a Travel Product (e.g. flight schedule change, cruise alteration, hotel closure):

  • We will use reasonable efforts to notify you as soon as we know; and 
  • We will assist you to understand your options (rebooking, credits, partial refunds, etc.), as allowed by the Supplier’s terms and the ACL. 

8.4 Refund Process
If a Supplier approves a refund:

  • The refund is first paid to TLC Getaways (as the booking agent); and 
  • We then remit the amount to you, less any agreed service fees or non-refundable components. 

Refund processing times can vary widely between Suppliers (for example, airlines may take several weeks or months).

8.5 No Shows
If you fail to check in, board or otherwise use a booked service (“no show”), you will typically lose the full value of that service and may not be entitled to any refund or credit.


9. Changes in Price & Itinerary

9.1 Price Adjustments
Even after full payment, some Suppliers may impose additional charges for:

  • Tax increases 
  • Fuel surcharges 
  • Regulatory changes 

If this occurs, we will notify you and explain your options. In some cases, you may be able to cancel; in others, you may need to pay the additional amount to travel.

9.2 Itinerary Changes
Suppliers may alter itineraries, departure times, routes or services for operational or safety reasons. Your rights will depend on the Supplier’s policy and the nature of the change.

We are not responsible for such changes but will support you in liaising with the Supplier.


10. Passports, Visas, Health & Travel Advice

10.1 Your Responsibility
You are responsible for ensuring you have:

  • A valid passport (usually with at least 6 months’ validity beyond your return date); 
  • All necessary visas, entry permits and electronic travel authorisations; 
  • Any required vaccinations or health documentation. 

10.2 Official Advice
We recommend that you check official travel advice and entry requirements via:

  • www.smartraveller.gov.au 
  • Relevant embassies/consulates for your destination(s) 

10.3 Health & Fitness
You should consult a doctor or travel health clinic about any recommended vaccinations or health precautions. You must ensure you are fit to travel and advise us of any mobility or medical needs at the time of booking.


11. Travel Insurance

11.1 Strongly Recommended
We strongly recommend that you take out comprehensive travel insurance at the time you pay your deposit to cover risks such as:

  • Cancellation and disruption 
  • Medical and hospital expenses 
  • Emergency evacuation and repatriation 
  • Lost, stolen or damaged luggage and personal items 
  • Travel delay and missed connections 

11.2 Policy Choice
It is your responsibility to choose a policy that suits your needs and to read the policy wording to understand inclusions, exclusions and conditions.

We are not responsible if you choose not to take out insurance or if your policy does not cover a particular event.


12. Frequent Flyer, Loyalty & Special Requests

12.1 Frequent Flyer Programs
You should provide your frequent flyer or loyalty membership details at the time of booking. We will pass these to the Supplier where possible, but:

  • We cannot guarantee that any points or status credits will be awarded; and 
  • Eligibility is determined by the Supplier’s program rules. 

12.2 Special Requests
Requests for special meals, seating, bedding configuration, room location, accessibility, etc., will be passed on to Suppliers, but cannot be guaranteed. We are not liable if such requests cannot be fulfilled.


13. Documentation & Tickets

13.1 Travel Documents
Travel documents (e.g. e-tickets, booking confirmations, vouchers, itineraries) will usually be issued electronically. It is your responsibility to:

  • Check all documents carefully upon receipt; and 
  • Notify us immediately if anything is incorrect or missing. 

13.2 Reconfirmation
We recommend you reconfirm flight times, check-in requirements and other key arrangements with the relevant Supplier at least 24 hours before departure.


14. Force Majeure – Events Beyond Our Control

If your travel is affected by events outside the reasonable control of us or the Supplier (such as natural disasters, pandemics, war, major weather events, strikes, government restrictions or similar), this may impact your ability to travel or the Supplier’s ability to provide the product.

In such cases:

  • Your rights to a refund, credit, rebooking or other remedy will depend on the Supplier’s policies and any applicable rights under the ACL; 
  • Our own service fees may remain non-refundable, except where otherwise required by law.
     

15. Our Liability

15.1 Australian Consumer Law
Nothing in these Terms & Conditions is intended to limit or exclude any guarantee, warranty, right or remedy you have under the Australian Consumer Law that cannot be lawfully excluded.

15.2 Liability of Travel Suppliers
The Travel Supplier is responsible for performing the Travel Product and is liable for any express or implied guarantees relating to its supply. Your primary legal rights in respect of the actual travel service are against the Supplier.

15.3 Limitation of Our Liability
To the extent permitted by law, TLC Getaways is not liable for:

  • Acts, errors, omissions, representations, warranties, breaches or negligence of Travel Suppliers or third parties; 
  • Any injury, loss, damage, delay, inconvenience or additional expense arising directly or indirectly from the Travel Products; 
  • Any indirect or consequential loss, such as loss of enjoyment or lost opportunities. 

Where our liability cannot be excluded, it is limited to the minimum extent permitted by law.


16. Privacy

We collect, use and disclose your personal information to:

  • Provide you with quotes, bookings and travel services; 
  • Communicate with you about your travel; 
  • Comply with legal obligations. 

We may share your information with Travel Suppliers and third parties involved in your booking. By booking with TLC Getaways, you consent to this use of your personal information.

17. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of Queensland, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Queensland in relation to any dispute arising out of these Terms & Conditions or your use of our services.


18. Your Acknowledgements

By proceeding with a booking with TLC Getaways, you confirm that:

  • You are 18 years or older and legally able to enter into contracts. 
  • You have read and understood these TLC Getaways Terms & Conditions. 
  • You have read (or will read) the relevant Travel Supplier’s terms and conditions. 
  • All information you provide is true, complete and accurate. 
  • You understand that prices, availability and conditions may change until paid and confirmed. 
  • You have considered obtaining travel insurance and checking travel advisories for your destinations.
